In the Electoral Commission of 1877, it was stated that Justice David Davis didn't know whether he would vote for Tilden or Hayes. The Democrats in the state legislature of Illinois then elected him Senator in hopes he'd choose Tilden, but he promptly resigned to take up his Senate seat.
