I noticed this bracket on my E90's exhaust is messed up. How mission critical is this if it's still on there tight?

This might be a stupid question. After doing my E90's front rotors and pads, when I spin the wheel it rubs against the new brake pads. Is this expected? I fully compressed the piston before installing the new pads.
